En este trabajo se examinan algunas cuestiones clave para la mejora de las pruebas periciales en el sistema penal mexicano a partir de las reformas que supone el Código Nacional de Procedimientos Penales, materia en la que éste es especialmente oscuro. La selección de los temas y, sobre todo, su abordaje, parte de la epistemología jurídica, asumiendo como objetivo de la institución probatoria la averiguación de la verdad y atendiendo a los diferentes sujetos en juego.

Background: The prevalence of anxiety and depression in young students is associated with biosocial factors and scholastic stress. However, few studies have evaluated emotional-affective symptoms that are related to the immune system and antioxidant parameters in young individuals without diagnoses of affective disorders.Aim: This study aims to assess the relationship between emotional-affective symptoms and glutathione concentrations and CD4 and CD8 lymphocyte counts in college students.Methods: College students completed standardized psychometric instruments, including the Perceived Stress Scale, Hamilton Anxiety Scale, Beck Depression (...) Inventory, Familiar Social and Friends Support Scale, and Rosenberg Scale. Blood samples were biochemically analyzed. Analyses of variance were conducted between four groups according to symptom severity.Results: A considerable prevalence of stress, anxiety, and depression symptoms was observed and negatively correlated with self-esteem and socio-familiar support. Perceived stress was sexually dimorphic. Although biochemical parameters were within reference ranges, glutathione, CD4, and CD8 tended to be lower in participants with anxiety and depression symptoms, which may be of predictive value.Conclusion: The relationship between antioxidant/immune parameters and socio-affective scores is latent in undiagnosed college students who might develop affective disorders. The findings suggest that during the initial development of affective disorders, stress management strategies should be implemented to help college students cope with the academic load and monitor negative changes in their physiological state. Uno de los temas recurrentes en el análisis de la prueba pericial, al menos en los sistemas de tradición romano-germánica, es la parcialidad o imparcialidad de los expertos, fundamentalmente considerada como un criterio para la atribución de valor probatorio. Por ello, vale la pena profundizar en este tema, distinguiendo en primer lugar diversos sentidos de “im/parcialidad”, para luego concretar mecanismos jurídico-procesales que ayuden a identificar cuándo un perito está siendo parcial a lo largo de las diferentes etapas probatorias.

This book offers a transnational perspective of evidentiary problems, drawing on insights from different systems and legal traditions. It avoids the isolated manner of analyzing evidence and proof within each Common Law and Civil Law tradition. The company at the service of today's society is reinventing itself to satisfy people's needs in a more efficient and adapted way. Globalization and digitization promote increasing interaction and new forms of economic organization such as collaborative economy. However, can it be understood that this new business model, more than others, has as its raison d'être in the search for the “common good”? A first approach suggests the presence of values related to collaboration between equals aiming at a common good. (...) However, the possible existence of a profit motive and the labor relations framework in which certain activities are carried out have created a debate on their ethical qualification. In this context, considering 278 companies in the collaborative economy sector, the relationship between the concept of “common good” and the collaborative economy is analyzed, while examining whether these new realities have an explicit ethical intention (of search for goods for people). According to the results, it is not possible to assert that these platforms have an ethical concern, but it is observed that they are in line with the common good and implicitly contribute to the service of society. Nowadays, the quality standards of higher education institutions pay special attention to the performance and evaluation of the students. Then, having a complete academic record of each student, such as number of attempts, average grade and so on, plays a key role. In this context, the existence of missing data, which can happen for different reasons, leads to affect adversely interesting future analysis. Therefore, the use of imputation techniques is presented as a helpful tool to estimate the value of missing (...) data. This work deals with the academic records of engineering students, in which imputation techniques are applied. More specifically, it is assessed and compared to the performance of the multivariate imputation by chained equations methodology, the adaptive assignation algorithm based on multivariate adaptive regression splines and a hybridization based on self-organisation maps with Mahalanobis distances and AAA algorithm. The results show that proposed methods obtain successfully results regardless the number of missing values, in general terms. (shrink)

The First World Congress on Evidential Legal Reasoning, organised by the Legal Culture Chair of the University of Girona, was held between June 6 and 8, 2018. The Congress was attended by 350 participants and featured 18 speakers from four continents. The three days of formal and informal presentations and discussions yielded excellent results, strengthening the interrelation between the legal communities and specialists of different traditions. The 18 papers from the Congress, reviewed by their authors based on the discussions and (...) the suggestions made at the Congress, have been compiled in this book. (shrink)

Scholars in the humanities and social sciences have turned to ethics to theorize politics in what seems to be an increasingly depoliticized age. Yet the move toward ethics has obscured the ongoing value of political responsibility and the vibrant life it represents as an effective response to power. Vázquez-Arroyo forcefully argues against the notion that modern predicaments of power can only be addressed ethically or philosophically through pristine concepts that operate outside of the political realm. The ‘black box’ in Stoic axiology refers to the mysterious connection between the input of Stoic deliberation (reasons generated by the value of indifferents) and the output (appropriate actions). In this paper, I peer into the black box by drawing an analogy between Stoic and Kantian axiology. The value and disvalue of indifferents is intrinsic, but conditional. An extrinsic condition on the value of a token indifferent is that one's selection of that indifferent is sanctioned by context-relative ethical principles. The demonstrations of monks in Tibet and Myanmar (Burma) in recent times as well as the age-old conflict between a predominantly Buddhist population and a Hindu minority in Sri Lanka raise the question of how the issues of human rights and Buddhism are related. The question applies both to the violation of basic rights in Buddhist countries and to the defence of those rights which are well-grounded in Buddhist teachings. The volume provides academic essays that reflect this up to now (...) rather neglected issue from the point of view of the three main Buddhist traditions, Theravada, Mahayana and Vajrayana. Resumen: Chile, a pesar de su historia migratoria, no ha generado programas educativos sustentados por políticas gubernamentales que propicien la adquisición de la variedad lingüística de la comunidad de acogida, por parte de la inmigración no hispanoparlante, integrando los referentes culturales de ambos colectivos. Se propone una alternativa a este olvido histórico y nos planteamos lo siguiente: ¿Qué elementos debiesen integrar un programa de adquisición de la variedad lingüística de la comunidad de acogida dirigido a inmigrantes haitianos propiciando el conocimiento (...) cultural? Se presenta el diseño e implementación de un programa que adopta la Hipótesis de Interdependencia Lingüística, en un aula dinámica donde se trabaja de forma colaborativa y situada. Se concluye que es posible educar en una segunda lengua a partir de la incorporación de elementos que propicien la interrelación de los aprendices en igualdad de conocimientos, y el uso de los códigos lingüísticos de los participantes como manifestación de respeto e interés por lo que cada uno pueda aportar a partir de su L1, develando su cultura de origen.: Chile, despite having a migration history, has not generated educational programs supported by government policies that encourage the acquisition of the linguistic variety of the host society, by non-Spanish-speaking immigration community, integrating the cultural referents of both collectives. It is suggested an option to this historical oblivion and we consider the following: What elements should be integrated into a program for acquiring the linguistic variety of the host society focused to Haitian immigrants fostering the cultural recognition? It is presented the design and implementation of a program that adopts the Linguistic Interdependence Hypothesis in a dynamic classroom working in a collaborative and situated way. As a conclusion, it is possible to educate in a second language from a program that incorporates elements that promote the interrelation of all participants in equality of knowledge, as well as the use of participants’ linguistic codes as a manifestation of respect and interest for what each participant can contribute from his/her L1, revealing their culture of origin. El presente trabajo se enmarca en la propuesta fenomenológica de Jean Luc Marion, comenzando por la crítica que él realiza a Husserl y Heidegger. Luego de adentrarnos en lo fundamental de su propuesta fenomenológica, ‘cuanto de reducción, tanto de donación’, podremos acercarnos a comprender la llamada que genera y su fenomenalización por medio de la respuesta que se apila en nuestra carne. Frente a lo propuesto por Marion, esperamos encontrar una posibilidad de acercarnos a indicios del pensamiento filosófico de Cristo (...) sobre el rol del tercero y su testimonio. El trabajo se centra, por lo tanto, en los rastros que nos deja el pensamiento de Cristo, que puede ser esbozado a partir de una escapatoria al pensamiento griego. (shrink)

This Element offers a systematic outline of ancient conceptions and uses of suspension of belief (understood broadly) while engaging with contemporary philosophy. It discusses the notion of epochē ('suspension of judgement') and other related terms, like aporia, aphasia, paradox, hypothesis, agnosticism, and Socratic wisdom. It examines the Academic and Pyrrhonian sceptics and some of their arguments and strategies for suspension. It also includes the use and conditions for suspension of belief in other philosophers like Socrates, Plato, Aristotle, the Stoics, Plotinus, (...) Protagoras, and Democritus. The Element is divided into four thematic sections, each addressing one of the following questions: What is suspension of belief? When does it arise? What could its scope be? Para esto, abordaremos la relación del ídolo con los distintos rostros que pretenden mostrarse como tal y luego el pensamiento sobre el icono cristiano. En este sentido, nos adentraremos en la propuesta estética cristiana y la posibilidad de pensar un arte a posteriori, es decir, que surge desde un acontecimiento, extendiéndolo (...) y haciéndolo más visible. Advocates of interactionism in the ethical criticism of art argue that ethical value impacts aesthetic value. The debate is concerned with “the intrinsic question”: the question of whether ethical flaws/merits in artworks’ manifested attitudes affect their aesthetic value (Gaut 2007: 9). This paper argues that the assumption that artworks have intrinsic ethical value is problematic at least in regards to a significant subset of works: fictional artworks. I argue that, insofar as their ethical value emerges only from attitudes attributable to (...) actual agents, fictional artworks only have extrinsic ethical value. I show that what is at stake for interactionism is whether ethical judgements concerning artists’ attitudes in a context, rather than manifested attitudes, are ever aesthetically relevant. I conclude that, without buying into extreme actual intentionalism, a still controversial theory of interpretation that ties artworks’ meaning to actual artists, interactionism fails to show that ethical flaws/merits are aesthetic flaws/merits. The purpose of this study is exposition on the themes of method and mysticism in the work of Simone Weil. Nearly a decade before the onset of her first mystical experience, Weil developed a method to be rigorously applied in daily philosophical reflection. She outlines this method in her dissertation on Descartes (1929-1930). I examine the question of how Weil applied method to philosophical reflection on her mystical experiences (onset 1938-1939). I analyze Weil’s mystical experiences as a type of transformative (...) experience in L. A. Paul’s strict sense of the term. On Paul’s view, an experience is transformative if it is both epistemically and personally transformative. An experience is epistemically transformative if the only way to know what it is like to have it is to have it yourself. An experience is personally transformative if it changes your point of view, including your core preferences (Paul, 2014). I present a thought experiment and textual evidence to motivate the claim that Weil’s mystical experiences meet Paul’s conditions for transformative experience. I then propose two epistemological facts that can be revealed by philosophical reflection on mystical experience. First, it is possible to read meaning erroneously in the appearances of things. Second, it is possible to come to hold to the certainty of a conviction for reasons that elude the intellect. My findings suggest that Weil’s late views on philosophy accommodate these two epistemological constraints, thereby demonstrating a possible connection between Weil’s mystical experiences and her mature views on the nature, scope, and proper method of philosophy. However, my preliminary findings also suggest that Weil’s early work on method may have anticipated these epistemological obstacles prior to the onset of her first mystical experience. Thus, further exposition of Weil’s method is needed to support or elucidate the claim (Rozelle-Stone and Davis, 2021) that Weil’s epistemology underwent significant changes because of her mystical experiences. Latin America is one of the most unequal continents in the world. This inequality translates into marked limitations in the possibilities of having a decent life for a high percentage of the population. Within the groups that are affected, women are undoubtedly even more so, because, in addition to shared economic and social inequalities with other vulnerable groups, they face discrimination based on gender. In Latin America, political protest has been undertaken by women who wish to denounce and abate the (...) injustices of which they are victims. These struggles have been analyzed by different thinkers. For the most part, feminist theories deal with the struggle of women against the oppressive behavior of patriarchy from the State or society. Others highlight the ability of women to contribute to social changes from socially accepted roles such as mothers, daughters, wives. These approaches ignore the difficulties experienced by female activists within the political mobilization. In this essay then we seek to document, analyze, and theorize about the patriarchal practices suffered by women activists - qua women- within the social organizations in Ciudad Juárez, as well as the forms of resistance they have opposed. Este artículo se propone mostrar que el significado de aisthesis para Protágoras responde al uso y significación de la filosofía jónica, esto es, aún significa indistintamente juicio, sensación, emoción, creencia, en fin, doxa. Esto tiene una consecuencia muy relevante para la comprensión del homo mensura y la tesis que afirma: aisthesis es episteme.

Experiential imagination consists in an imaginative projection that aims at simulating the experiences one would undergo in different circumstances. It has been traditionally thought to play a role in how we build our lives, engage with other agents, and appreciate art. Although some philosophers have recently expressed doubts over the capacity of experiential imagination to offer insight into the perspective of someone other than our present-selves, experiential imagination remains a much sought-after tool. This paper substantiates pessimism about the epistemological value (...) of these uses of experiential imagination by developing an embodied approach. Our thesis is that experiential imagination is _robustly embodied_ because the _sociohistorically situated_ body makes an irreducible contribution to the imaginative project, and that, as such, it is constrained by who we are as _concrete_ agents. We argue that experiential imagination is an embodied, virtual exploration of imagined scenarios that depends on our situated history of sensorimotor and affective interactions. We conclude that experiential imagination is much more limited than commonly acknowledged, as it can hardly be divorced from who we are and where we have been. (shrink)

This article examines what constitutes an ethical flaw in artworks and asks which ethical flaws are relevant in determining works. ethical and aesthetic values. I argue that while most of the discussion has simply taken for granted that it is intrinsic ethical flaws that should be taken into account, there are further important differences in the type of intrinsic ethical flaws that artworks display. I identify two different types of ethical defects in artworks, fictional and actual, and argue that this (...) distinction has important consequences for debates surrounding the ethical value of works of fiction.
